1. What Bovio is

Bovio is a Discord application that brings the "Bulls and Cows" code-guessing game to Discord servers. The free tier offers the core 4-digit game, personal stats, server leaderboards, and a global daily challenge. The premium tier, sold per-server through Discord's monetization system, unlocks additional difficulties, gameplay modes, tournaments, and customization.

These Terms govern your use of Bovio. By installing or interacting with Bovio, you agree to them.

2. Eligibility

To use Bovio you must:

• Meet Discord's minimum age requirement for your region (13 in most countries; 16 in some EU member states such as Germany)
• Be authorized to install applications in any Discord server where you add Bovio — typically this means having the "Manage Server" permission
• Not be barred from using Bovio by these Terms, Discord's terms, or applicable law

You also agree to comply with Discord's Terms of Service and Community Guidelines at all times while using Bovio. Violation of those is also a violation of these Terms.

3. Acceptable use

You agree NOT to:

• Cheat in the daily challenge (e.g. by sharing answers in chat to inflate stats; we may zero out scores for guilds caught doing this)
• Use Bovio to harass, dox, or abuse other users
• Scrape, mirror, or attempt to reverse-engineer the bot
• Run automated scripts or alt-accounts to play on your behalf
• Attempt to disrupt the service (DoS, exploiting bugs without responsible disclosure, etc.)
• Submit content that violates Discord's policies — Bovio only accepts numeric input via slash commands, but we reserve the right to act on bug-abuse cases

If you find a security vulnerability, please report it privately to info@fiftify.com before public disclosure.

4. Server administrators' responsibilities

Adding Bovio to a Discord server is the responsibility of an authorized server administrator. By doing so, you confirm:

• You have permission to install applications in that server
• You will not enable Bovio in channels where minors are present in ways that violate local law
• You accept that other members of the server can use Bovio's free features without per-user consent, since Discord's bot model assumes server-level admission

5. Premium subscriptions

5.1 What you buy

Bovio Premium is a per-guild monthly subscription sold through Discord's Premium Apps system. One subscription covers all members of one Discord server.

Current price: $4.99 USD / month / server. Discord automatically converts to your local currency.

A subscription unlocks the premium features listed in the Bovio App Directory listing and in our /help command. The exact feature set may evolve; we will not remove a feature you paid for in the current billing cycle.

5.2 Billing and renewal

• Billing is handled by Discord. Discord may charge you via Stripe or your platform-of-choice payment method.
• Subscriptions auto-renew monthly until cancelled.
• You can cancel any time from your Discord User Settings → Subscriptions. Cancellation takes effect at the end of the current billing period.
• We never see or store your payment card details.

5.3 Refunds

Refund eligibility is described in our separate Refund Policy. In short: a 3-day refund window from purchase if the premium features have not been used, in line with Discord's standard policy for Premium Apps.

5.4 Service changes

We may change premium pricing or feature scope with at least 30 days' notice, communicated via the Bovio support page and a Discord DM to each subscribed server's owner. Price changes apply only to renewals after the notice period; the price you have already paid for is honoured until renewal.

6. Free tier

The free tier of Bovio is provided as-is, without payment. We may rate-limit or temporarily disable free-tier features to protect service stability. We will not introduce ads into the free tier — this is a hard product commitment.

7. Intellectual property

• The "Bulls and Cows" game itself is in the public domain (it predates modern intellectual property law)
• The "Bovio" name, logo, custom emoji, and brand assets are the property of Fiftify Inc.
• The Bovio source code is proprietary; the repository is private at this time

You receive a non-exclusive, non-transferable, revocable license to use Bovio for its intended purpose (playing the game in a Discord server). You may not use the Bovio name or logo to suggest endorsement of your own products without written permission.

8. Termination

8.1 By you

You may remove Bovio from any server you administer at any time, with no notice. To erase your personal data, run /forget-me (see Privacy Policy § 8).

8.2 By us

We may suspend or terminate Bovio's presence in a server, or restrict a user, if:

• The server or user violates these Terms or Discord's Terms
• We are required to by law or by Discord
• The server's owner asks us to (e.g. to clear out a problematic install)
• Operation in that server poses a security or stability risk to the wider service

When practical we will notify the server owner first. Termination does not entitle you to a refund of any unused portion of a premium subscription, beyond the 3-day window described in our Refund Policy, unless required by mandatory local consumer-protection law.

9. Disclaimers

Bovio is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent allowed by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that Bovio will be uninterrupted, error-free, or that bugs will be corrected on any specific timeline.

10. Limitation of liability

To the maximum extent allowed by law:

• Our aggregate liability to you for any claim arising out of these Terms or your use of Bovio is limited to the amount you actually paid for Bovio Premium in the 12 months preceding the claim, or USD 50, whichever is greater.
• We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

Some jurisdictions don't allow these limitations; where that's the case, they apply only to the extent legally permitted.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of:

• Your violation of these Terms
• Your violation of Discord's Terms while using Bovio
• Your misuse of Bovio in a way that causes harm to others

This does not apply to claims arising from our own willful misconduct or gross negligence.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced:

• On this page (updated Effective date)
• On the Bovio support page
• Via Discord DM to subscribed server owners
• At least 30 days before they take effect for paid features

Continuing to use Bovio after the effective date constitutes acceptance. If you don't agree, remove Bovio from your servers and stop using it.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. [review with lawyer — confirm whether a Ukraine-based operating entity is intended; if so, this clause must be revised]

Any dispute arising out of or relating to these Terms or to Bovio shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Delaware, USA. Each party shall bear its own costs. Disputes will be conducted on an individual basis and not in a class, consolidated, or representative action.

Consumers domiciled in the EU/EEA/UK retain the right to bring proceedings in their local courts under mandatory consumer-protection law.

14. Miscellaneous

• Severability: if any part of these Terms is found unenforceable, the rest remain in effect.
• No waiver: failure to enforce a provision is not a waiver of our right to enforce it later.
• Entire agreement: these Terms plus the Privacy Policy and Refund Policy are the entire agreement between you and us regarding Bovio.
• Assignment: you may not assign these Terms; we may assign them to an affiliate or in connection with a sale of the business.
